A. Master Terms of Service (Members & Residents)

1. Acceptance of Terms & Eligibility

By creating an account or using Sova (the "Service"), you agree to these Terms and the policies incorporated by reference. You must be 18 years or older (or the age of majority in your jurisdiction, if higher), legally capable of entering this Agreement, and not barred from use under applicable law.

2. Accounts & Verification

You must provide accurate information and keep it current. We may require KYC/age/ID verification and may deny, suspend, or terminate accounts for risk, policy, or legal reasons. Accounts are personal and non-transferable. You are responsible for activity under your credentials.

3. Service & AI-Assisted Interactions

Sova enables Residents (creators) to monetize interactions with Members, including subscriptions, tips, unlocks, messaging, live sessions, and AI-assisted experiences. You acknowledge that some interactions, messages, or content may be generated, assisted, or enhanced by creator-authorized AI systems and may not be real-time personal creator responses.

4. Pricing, Credits, Fees & Taxes

Purchases may be priced in local currency or Sova Credits (virtual tokens with no cash value). Prices can vary by channel (web vs in-app). Taxes and storefront fees may apply. You are responsible for taxes applicable to your purchases or earnings.

5. Resident Monetization Splits

Unless otherwise shown in-product: AI My Sova Chat: 20% Resident / 80% Sova; Direct Messages & Unlocks: 80% Resident / 20% Sova; Beyond (tips, bids, custom content): 80% Resident / 20% Sova. Future changes are announced in advance and are not retroactive.

6. Content Ownership & License

You retain ownership of your content. You grant Sova a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, process, adapt, distribute, and display content as required to operate, secure, and improve the Service, including moderation and AI safety tooling.

7. Likeness, Consents & Co-Creators

You must have all required rights and written consents for names, images, voices, likenesses, and performances included in content, including AI-synthetic derivatives. You must maintain proof and provide it on request.

8. Sensitive/Adult Content Rules

No minors or content that appears to involve minors. No non-consensual or exploitative content, trafficking, doxxing, or illegal acts. Where required, creators are solely responsible for record-keeping obligations. Apparent CSAM is reported to proper authorities.

9. Prohibited Uses

You may not violate law or third-party rights, upload illegal/deceptive/harmful content, impersonate others, interfere with the Service, bypass payments, scrape data, spam/scam users, or access accounts without authorization.

10. Moderation & Notice-and-Action

We may review, filter, remove, or restrict content/accounts to enforce law and policy, manage safety, and reduce risk. We provide reporting tools, process valid copyright notices, and may terminate repeat infringers.

11. AI Transparency

AI outputs may be synthetic and may be filtered, watermarked, rate-limited, or refused. Residents must label AI content where required and must not misrepresent AI output as real-time human response.

12. Third-Party Services

The Service may integrate third-party vendors for payments, KYC/AML, analytics, hosting, and AI infrastructure. Separate terms and privacy policies apply to those services.

13. Refunds, Chargebacks & Fraud

Except where required by law or expressly stated, purchases are final once delivered or once time-based services begin. Chargebacks can trigger deductions, fees, and account review.

14. Payouts to Residents

Residents must provide valid payout and tax information and pass compliance checks. We may hold, offset, or suspend payouts while investigating fraud, abuse, legal requests, or policy violations.

15-48. Additional Legal Terms

Additional terms include sanctions/export restrictions, app-store compliance, termination and survival, disclaimers, limitation of liability, indemnification, arbitration/class-action waiver, time limits for claims, DSA and privacy obligations, force majeure, anti-scraping, reserves/holds/set-off, biometric checks, SMS terms, geoblocking, and miscellaneous legal provisions.

B. Resident (Creator) Agreement

Residents must be 18+, complete verification, and comply with all applicable consent and recordkeeping requirements. Monetization splits, payout thresholds, reserves/holds, anti-circumvention, and termination rights apply as described in the Agreement.

C. Payment & Payout Terms

Web and in-app channels may use different processors and pricing. Credits are non-cash-value virtual tokens. Purchases are generally non-refundable once delivered. Payouts are subject to thresholds, compliance checks, and processing timelines.

D-O. Additional Policies and Appendices

Sections D through O include Community Guidelines, Privacy Policy, DMCA procedures, Safety and Moderation, AI and Likeness rules, Cookie Policy, App Store and DSA appendices, Data Retention and Law-Enforcement Requests, Refund and Chargeback process, Promotions Terms, and Glossary/Contacts.
